    Descrizione (IT)Il negozio in asta è sito a ridosso della Via Flaminia a soli 600 metri dagli Ospedali Riuniti Torrette di Ancona e dall’Università Politecnica delle Marche facoltà di Medicina e Chirurgia. Il negozio ha una superficie di 185 mq e si sviluppa su due piani. L’accesso si ha da via Flaminia tramite una vetrina di ingresso e dall’unità confinante (Lotto 2) collegata al livello del piano seminterrato. I locali venivano utilizzati per la vendita e somministrazione di cibo e bevande. All’interno sono presenti alcuni arredi tipici di questi locali. Il collegamento al piano seminterrato avviene solo attraverso il locale confinante (Lotto 2) entrando dal portone condominiale. Al piano interrato non si è potuto accedere a causa degli sbarramenti posti nell’unità confinante al fine di evitare l’ingresso ad estranei. Il piano terra è composto da una sala bar e da vari locali di servizio come laboratorio, dispensa, servizi igienici, i quali si affacciano sul lato ferrovia. Sono presenti difformità catastali ed urbanistiche. Si fa presente che una porzione di immobile (quella a ridosso della ferrovia) è costruita su area di sedime di proprietà di Ferservizi Spa in virtù della quale era stato stipulato un contratto di locazione per la porzione di terreno sul quale insiste l’ampliamento. A seguito della convalida dello sfratto per morosità per canoni non corrisposti il contratto di locazione si è risolto per inadempimento grave della ditta fallita che, essendosi impegnata a riconsegnare in pristino stato l’immobile, veniva condannata alla demolizione a sua cura e spese con sentenza n. 1376/2021 del 02/011/2021, RG n. 2331/2021, entro 90 giorni dalla notifica del provvedimento. La demolizione non è stata effettuata, per cui essa rimarrà a cura e spese dell’acquirente. Si prega di notare che nella fase di istruttoria riguardante il rilascio della Concessione Edilizia n. 103 del 1981 e riguardante altra unità oggetto di stima, l’ufficio comunale annota che l’immobile insiste su un’area destinata alla viabilità (art. 18 delle NTA del PRG vigente all’epoca) e destinata a zona di recupero. L’immobile risulta censito al Catasto Fabbricati del Comune di Ancona al Foglio 29: Particella 52 – Sub. 11 – Categoria C/1 – Classe 5 – Consistenza 106 mq – R.C. € 3.120,43

The store for auction is located close to Via Flaminia, just 600 meters from the Torrette Hospitals of Ancona and the Polytechnic University of the Marche, Faculty of Medicine and Surgery.
The store has a surface area of 185 sqm and is spread over two floors.
Access is from Via Flaminia through an entrance window and from the adjacent unit (Lot 2) connected to the basement level. The premises were used for the sale and serving of food and beverages. Inside, there are some typical furnishings of these establishments. The connection to the basement occurs only through the adjacent room (Lot 2) entering from the condominium door. Access to the basement was not possible due to barriers placed in the adjacent unit to prevent entry by outsiders. The ground floor consists of a bar area and various service rooms such as a laboratory, pantry, and restrooms, which overlook the railway side.
There are discrepancies in cadastral and urban planning.
It should be noted that a portion of the property (the one adjacent to the railway) is built on land owned by Ferservizi Spa, for which a lease agreement was made for the portion of land on which the extension stands. Following the validation of the eviction for non-payment of rent, the lease was terminated due to the serious default of the bankrupt company, which, having committed to return the property in its original state, was condemned to demolition at its own expense by judgment no. 1376/2021 of 02/11/2021, RG no. 2331/2021, within 90 days of notification of the provision.
The demolition has not been carried out, so it will remain at the buyer's care and expense.
Please note that during the investigation phase regarding the issuance of Building Permit no. 103 of 1981 concerning another unit subject to appraisal, the municipal office notes that the property is located on an area designated for road use (art. 18 of the NTA of the PRG in force at the time) and designated for recovery area.
