Small villa consisting of seven and a half cadastral rooms, located on a first floor below street level, ground floor and first floor, with garage space on the street level below street level.
The CTU's report shows that there are several discrepancies with respect to the cadastral data in the deeds. In addition to the closures of internal doors, the movement of partitions and the creation of new openings (windows), an increase in the volume of the i.u. with the addition of a new environment. Furthermore, the room on the first floor, identified as "first floor plan", has been made habitable. This indicated floor is actually an "attic room" that can be used at most as a storage room as the heights do not allow it to be identified as habitable. Therefore the property, as indicated by the CTU, is not in the conditions set forth in article 40, paragraph 6 of law no. 47/1985, nor of the art. 46 paragraph 5 of Presidential Decree 380/2001, and the abuses found cannot be remedied or forgiven pursuant to Legislative Decree 269/2003. In fact, as regards the redistribution of the internal spaces and the modification of the prospectus, the CTU reports that, through the presentation of the relevant authorization, it is possible to remedy them for a cost equal to approximately € 1,500 including a fine and approximately € 1,000 for administration fees and fees for technicians competent in urban planning for the drafting of the necessary papers. It will also be necessary to update the cadastral plan of the property, with a cost of approximately €500.00. While as regards the increase in volume (creation of a new environment), it is not possible to regularize it and the state of the places will have to be restored, bringing it back to the executive project presented to the Municipality of Mascalucia, with an indicative cost, per unit, equal to € 10,000.00 including demolition, transport and landfill disposal and restoration. Costs and expenses, already deducted from the estimated price.
