Deposit
The present auction is subject to a deposit of
EUR 35.000,00.

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Je třeba zdůraznit, že majetek je nabízen k prodeji jako celek, protože byla uzavřena předběžná kupní smlouva ze dne 04/05/2022, řádně zapsaná, jejímž předmětem je převod ve prospěch společnosti v úpadku - již vlastníka podílu 1/2 - nebo třetím osobám, které budou jmenovány, zbytek pozemků, který bude tedy převeden po přidělení.
Stavební pozemky o rozloze 12.425 m² spadají do stavebního sektoru označovaného jako C3.2 Lu Gialdinu a spadají do podzóny C1.10 (čl. 35 NTA Územního plánu obce Santa Teresa Gallura) a jsou tedy oblastí podléhající parcelaci s limity a stavebními a urbanistickými omezeními vyplývajícími z aplikace příslušného předpisu na podzónu C1.10.
Správce si vyhrazuje právo přijímat a hodnotit nabídky nižší než výchozí cena uvedená výše v rámci 25%.
Tato nabídka bude hodnocena pouze po skončení této aukce podle uvážení orgánů řízení, pouze v případě, že nebudou předloženy neodvolatelné nabídky ve výši rovné nebo vyšší než výchozí cena.
Aby bylo možné učinit nabídku za výše uvedených podmínek, případní zájemci NEMUSÍ následovat postup "DOKONČENÍ NABÍDEK ZA VÝCHOZÍ CENU AUKCE", ale budou povinni zaslat žádost na e-mailovou adresu gorealbid@pec.it pro zjištění podmínek předložení a obdržení příslušného formuláře nabídky.
V každém případě budou neodvolatelné nabídky na koupi předložené na základě výše uvedených podmínek podléhat aplikaci Buyer’s Premium plus zákonné DPH, jak je uvedeno v obecných a specifických podmínkách a v přiloženém oznámení o prodeji.
