The present gathering is subject to a mandatory deposit of 10% of the starting price for each lot

Deposit has to be necessarily credited before the gathering deadline.
In case of deposit payment via bank tranfers, in order to accelerate the participation, the user is advised to send an official proof of the deposit payment to the following address: info@gobid.it
In case participants will not award any lot, deposit will be refunded within working 20 days from auction deadline, with no interests applied.
If, in case of awarding, after deposit payment, the bidder will not comply with the payment terms, the deposit will not be refunded.
Participation Rules:
The sale will take place according to the following phases:
- Collection of irrevocable purchase offers (PHASE 1)
The collection will be carried out using the following methods:
All bidders, except those legally not admitted to the sale, after registering on the website www.gobid.it, will be required to send an irrevocable purchase offer for a free amount by completing the participation form (published on line) and send it signed, for acceptance of the proposed conditions, to the following address:
gobid@pec.it
together with the bank transfer accountant certifying the payment of the requested security deposit.
Irrevocable purchase offers submitted by potential buyers must be accompanied by the payment of the required security deposit, the payment of which will itself constitute a formal purchase commitment on the part of the subscriber to each offer.
The best offer received at the certified email address provided by the Gobid Group can be used as an auction basis for a competitive sales experiment to be carried out on the Platform.
The Gobid Group will take care to inform all bidders in any way whether or not they are the best bidders at the time of formalizing the aforementioned irrevocable purchase offer.
The Owner/Seller reserves, at its sole discretion, the right to accept or reject irrevocable purchase offers presented by potential buyers. Offers not deemed appropriate may, therefore, be rejected by the Owner/Seller.
If the best offer is accepted, the Owner/Seller will appoint the Gobid Group to carry out the subsequent sale, to be carried out via online auction on the basis of the best offer received and the specific conditions of which are set out below.
Offers must be formulated according to the methods indicated in the attached offer form and must contain:
- the identification of the offeror, with the complete indication of the personal details and details of an identification document, the indication of the tax code and, in the case of a married natural person, the property regime in place between the two spouses;
- the Chamber of Commerce certificate of the company or sole proprietorship and an identification document of the legal representative in the case of a legal person or of the owner in the case of a sole proprietorship;
- the price offered
Completing the form will imply acceptance of the conditions of use of the platform www.gobid.it and of the general and specific terms of the collection and any subsequent auction.
- Exclusively online timed auction (PHASE 2)
In the case of multiple offers admitted, the best offer received at the certified email address provided by the Gobid Group may be used as the auction basis for a competitive sales experiment to be carried out on the Platform.
This offer will be formalized by the Gobid Group, in the name and on behalf of the bidder, through an online bet on the platform, for an amount equal to the value of the aforementioned offer, while the other bidders will be invited, instead, to make a raise on the platform , according to the methods published online on the web page dedicated to the auction.
In order to identify the best offer received, please refer to what is indicated in the sales notice.
The Gobid Group will take care to inform all bidders in any way whether or not they are the best bidders at the time of formalizing the aforementioned irrevocable purchase offer.
Availability of Lots
All charges deriving from the sale, including tax ones, and all expenses connected to the cancellation of prejudicial formalities are borne by the buyer.
Payment method
All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award notification (see general conditions).
Payment deadline
The lots awarded by the user must be paid for within 30 days of the award together with the expenses related to the sale and the notary fees
The Buyer's Premium must be paid within 15 days of the award.
Property Transfer
The sale will be finalized after full payment of the hammer price, expenses and Buyer's Premium.
The buyer is responsible for notary fees, where applicable, legal taxes and all fiscal and non-fiscal expenses relating to the sale.
For anything not provided for here, current laws apply.
Withdrawal of the awarded lots
The collection of the awarded lots by the buyer can only take place after the actual collection of payments of the hammer price and the expected commissions (Buyer's Premium, additional management costs).
In any case, the withdrawal must be completed no later than 45 days from the settlement of the award amounts.
All lots not collected within the deadline indicated above will be subject to a daily late payment of EUR 50.00. In the event that the goods are not collected within 30 days of the collection deadline, the sale will be considered automatically terminated and the amounts paid by the successful bidder (Sold Lots - Buyer's Premium, additional management charges and any additional fees paid) will be retained as a compensatory penalty.
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to organize their collection in any way.
The collection operations must be carried out by the buyer in compliance with current safety regulations established by law; the same will therefore be required to make the necessary adjustments in this sense also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
The buyer is responsible for any dismantling, handling, loading and transport of the awarded lots and, in the case of registered movable property, for carrying out the procedures necessary to carry out the necessary transfers of ownership.
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable property, before the relevant transfer of ownership has been completed.
Additional specific terms
Buyer's Premium: A charge of 5,00% + VAT will be added to the price of each awarded lot.
The Buyer's Premium will have a minimum amount of 25 € (+ VAT at 22% where applicable) of each of the lots awarded or combinations as minimum commissions.
VAT: Value Added Tax at a rate of 22,00% will be calculated on the awarding price and added to it. (where applicable)
Extra-Time
In case a winning offer will be submitted within 5 minutes before the auction deadline, the time to place another bid will be extended for 5 more minutes from the last bid received. Every other winning bid submitted within 5 extra-time minutes, will extend the time for placing another bid for 5 more minutes from the last bid received and so forth. Automatic overbids in case of maximum bid (proxy bid) are considered winning bids as well.
The sale of the goods is arranged for the goods seen and liked in the factual and legal state in which they are found. The guarantee for defects does not apply. It cannot be challenged due to damages.
Consequently, the existence of any defects or lack of quality or non-conformity of the thing sold cannot give rise to compensation, indemnity or price reduction.
Any liability on the part of the Gobid Group regarding the existence of third party rights on the goods being sold is excluded.
The sale takes place with the obligation and responsibility of the successful tenderer to ascertain their compliance with safety regulations.
In the event of the emergence of any disputes relating to the interpretation of the provisions contained in the general and specific conditions reported on the platform, possibly translated into other languages, the Italian version of the text will prevail.
