The sale takes place in the state of fact and law in which the goods are found, with all possible appurtenances, accessions, reasons and actions, active and passive easements; the sale is by body and not by measure; any measurement differences will not give rise to any compensation, indemnity or price reduction.
This forced sale is not subject to the rules concerning the guarantee for defects or lack of qualitỳ or discrepancies of the thing sold and charges of any kind - including, for example, urban planning or those deriving from critical environmental issues of any kind, especially and entity such as to require reclamation operations or other interventions required by Legislative Decree 50/2016, even if hidden, unrecognizable or in any case not highlighted in the appraisal, will not be able to give rise to any compensation, indemnity or reduction of the price, since taken into account in the evaluation of the assets.
Although the description of the properties is sufficiently competitive and exhaustive with regard to the presence of polluting substances on site and the presence of underground and above-ground tanks and cisterns, used for fuel oils and recovery of the dyeing washing water is highlighted, (as already indicated in appraisal) as well as the circumstance relating to part of the coverings carried out in eternity, for which interventions required by the current environmental legislation are required by the buyer and with exemption from any liability by the procedure, at the same time the subsequent emergence of a contamination by pollutant qualitatively or quantitatively different or further, so that the presence of hidden defects or lack of quality of the Properties may never be objected to the Company and the Judicial Liquidator as a consequence of such subsequent events.
